subject to the provision of ~ は定型的な表現で、契約書などの法律文書によく使用されます。「~の規定に従うことを条件に」「~の規定に従い」などと訳します。
subject to the terms and conditions of this Agreement なども同様です。「本契約の諸条件に基づき」と訳しても構いません。
2では、to the extent の部分から「~の範囲において開示することができる」と訳すのは、日本語として自然な訳文にしにくい構文ですので、訳例のように文章の前から訳しおろしています。文章の構成によって、訳し方の工夫が必要です。

「~もかかわらず」という譲歩の意味を表す前置詞です。
notwithstanding the foregoing(その他に above、foregoing paragraph など)のような使い方をします。

【例文】
