subject to the provision of ～ は定型的な表現で、契約書などの法律文書によく使用されます。「～の規定に従うことを条件に」「～の規定に従い」などと訳します。
subject to the terms and conditions of this Agreement なども同様です。「本契約の諸条件に基づき」と訳しても構いません。
2では、to the extent の部分から「～の範囲において開示することができる」と訳すのは、日本語として自然な訳文にしにくい構文ですので、訳例のように文章の前から訳しおろしています。文章の構成によって、訳し方の工夫が必要です。

「～もかかわらず」という譲歩の意味を表す前置詞です。
notwithstanding the foregoing(その他に above、foregoing paragraph など)のような使い方をします。
【例文】
1. Notwithstanding the foregoing, the license provided herein does not permit the Customer to, and Customer agrees not to and shall not modify, unbundle, reverse engineer, or create derivative works based on the Software.

whether ～ or not の形で「～であろうとなかろうと」、あるいは whether A or B の形で「AであろうとBであろうと」という譲歩の意味を示す表現です。
【例文】
1. This agreement sets forth the entire agreement and understanding between the parties with respect the subject matter hereof and supersedes all prior discussions, representations, understandings and agreements, whether oral or in writing between the parties with respect to the said subject matter.
2. WE MAKE NO WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, AS TO THE INFORMATION IN THIS PRESENTATION.
1.
