herein や hereafter、hereunder など、契約書に使われることが多い言葉ですが、先にも述べたとおり、here が何を指しているかについてルールがあるわけではないので、文脈から読み取ります。
here～ は基本的に this ～の意味です。

いずれの当事者も、他方当事者の事前の書面による同意を得ずに、本契約または本契約に基づく自己の権利もしくは義務を、譲渡または移転することはできない。

この hereunder は、under this Agreement と置き換えられます。
このように、here～は、this＿と置き換えられるのですが、＿の部分が何であるかには注意が必要です。

１の場合の hereto は、to this agreement に置き換えることができます。決まりきった表現の条文ですし、これ以外の解釈はありません。
2の場合はしかし、この条文の前の部分を読まなければ、herein が in this subsection なのか、in this section/paragraph/part/article なのか、あるいはin this agreement なのかは分かりません。訳例では一応、「本項」としておきましたが、そうではない可能性もあります。
3のhereinafter は、in this agreement(License) and after this sentence に置き換えられるでしょう。
4のherefrom は、from this agreement です。２の herein と同様、this agreement 以外のものを指している可能性も完全には否定できませんが、紛争に関しては免責条項などでも disputes arising out of this agreement などという文言がよく見受けられるので、here は this agreement を指していると解釈してまず間違いはないと思います。
5のhereof は、この条文の文脈上、of these Terms of Use に置き換えられます。
